Road Rage in Pennsylvania: When Losing Your Temper Turns Into Criminal Charges

October 19, 2026
Choosing Your Defense Attorney

Somebody cuts you off. Somebody curses at you or gives you the finger. You honk, get angry, and maybe say something back. These things happen, but a few seconds of frustration can escalate into an arrest, criminal charges, and court appearances.

Sitting behind the glass and metal of your car might make you feel big and bad. But pulling a firearm during an argument can change your life. First, the other person may have a gun and be willing to shoot you. Second, displaying or pointing a firearm to threaten someone can lead to charges such as terroristic threats and simple assault, depending on your conduct, intent, and the circumstances. A firearm does not have to be fired for criminal charges to follow. Whether someone acted in lawful self-defense requires a separate, fact-specific analysis.

The same problem applies to other weapons. Pulling out a knife, grabbing a bat, or threatening someone with another object can lead to criminal charges. Pennsylvania’s simple assault provision under Section 2701(a)(3) covers attempting through physical menace to make another person fear imminent serious bodily injury. You do not have to actually hit someone for that provision to apply. Possessing an instrument of crime may also be charged when the object qualifies under the law and you intend to use it criminally.

Your car can also become part of a serious criminal case. Intentionally driving into someone or using a vehicle to try to injure them can lead to felony aggravated assault charges, depending on the intent, injuries, and surrounding circumstances. At SKA Law Group, we have handled cases involving allegations like these. The consequences can extend far beyond a traffic ticket.

My advice? Let it go. Who cares if somebody cut you off? Who cares if they cursed at you or gave you the finger? Their behavior is not worth your freedom, your safety, or the stress and anxiety of going to court. Create distance, avoid engaging, and call 911 if you face an immediate threat.

As a criminal defense attorney, I see how quickly a bad decision can turn into a serious case. Take a breath, keep moving safely, and get home to your family.
