Understanding Rape vs. Sexual Assault in Pennsylvania

Rape (18 Pa.C.S. § 3121)

Rape is graded as a First-Degree Felony (F1). A standard conviction carries a maximum penalty of up to 20 years in prison and a $25,000 fine. However, if the victim is a child under 13, the maximum sentence increases to 40 years, and if serious bodily injury occurs to a child under 13, it can result in a maximum term of life imprisonment.

Sexual Assault (18 Pa.C.S. § 3124.1)

Sexual assault is defined more broadly. A person commits sexual assault when they engage in sexual intercourse or deviate sexual intercourse with a complainant without the complainant’s consent, in situations that do not meet the specific elements of rape (such as forcible compulsion).

Sexual assault is graded as a Second-Degree Felony (F2), punishable by up to 10 years in prison and a $25,000 fine.

Megan’s Law and Sex Offender Registration

A conviction for rape or sexual assault in Pennsylvania will almost certainly trigger mandatory registration as a sex offender under the Sex Offender Registration and Notification Act (SORNA), commonly known as Megan’s Law.
