The Role of Magisterial District Courts in Montgomery County
There are 30 magisterial courts within Montgomery County alone with many more throughout the commonwealth. Magisterial Judges play a similar role as regular judges; however, they typically only hear the initial phases of non-summary offenses, such as felony cases. They’re elected officials that serve a six-year term. They are also informally known as Justices of the Peace; however, this is an outdated title that no longer has any practical application. Being an attorney or admission to the state bar association isn’t a requirement to become a Magisterial Judge. The state does provide training for these individuals that take do not hold bar credentials.
The Montgomery County Magisterial District Courts are where summary offenses are heard from beginning to end. These offenses are the lowest level of misdemeanor crimes in Pennsylvania; however, there can be rather serious consequences even for lower level offenses such as fines and jail time. Some of the most common cases heard in these courts include non-jury trial citation based cases such as:
- Retail theft ($150 or less)
- Criminal mischief
- Harassment
- Disorderly conduct
- Public intoxication and more
