Pennsylvania offers several diversionary programs that may allow eligible individuals to resolve a criminal case without a conviction and, in many circumstances, pursue an expungement after successful completion.

ARD (Accelerated Rehabilitative Disposition) is one of the most common structured diversionary programs in Pennsylvania. It is generally available to certain first-time offenders and often involves conditions such as supervision, community service, treatment, or other requirements. Upon successful completion of the program, the charges are typically dismissed, and the individual may be eligible to seek an expungement.
Section 17 Disposition is another option available in certain drug-related cases. While eligibility and requirements vary, successful completion can result in the dismissal of charges and may allow an individual to pursue an expungement. Individuals should understand that participation may involve admissions or stipulations depending on the circumstances of the case.
The AMP Program (Alternative Misdemeanor Program) is available in Philadelphia for certain eligible misdemeanor offenses. It is often considered a less intensive alternative to some other diversionary programs. Upon successful completion, the charges may be dismissed, and the individual may be eligible for an expungement.
Every case is different, and eligibility for these programs depends on the facts of the case, criminal history, and the policies of the court and prosecutor’s office.
