Possession, sale, manufacturer, or trafficking of marijuana is a crime in Philadelphia. Marijuana is illegal under both federal and state laws. It is classified as a Schedule I substance. An arrest for any of these charges can cause a conviction that leads to time in jail or prison, steep fines, and a criminal record that follows you wherever you go in life.
A marijuana conviction on your criminal record may negatively impact employment and housing opportunities, not to mention cause a tarnished name around town. If you’re arrested for any type of marijuana charge, it is important to speak to an experienced criminal lawyer who handles such types of cases.

Philadelphia Marijuana Decriminalization Act
Although recent actions to decriminalize marijuana mean fewer arrests and penalties for many people found in possession of marijuana in small amounts for personal use, there is still a concern for anyone found with over 30 grams of marijuana. A $25 fine is imposed for anyone found in possession of under 30 grams of marijuana. Decriminalization in no ways means that marijuana is legal.
Marijuana Possession Penalties
What happens to people found guilty of marijuana-related crimes in Philadelphia? There isn’t a one-size-fits-all punishment for marijuana-related crimes. The amount of marijuana involved, whether the drug was trafficked, if there was a minor involved if the incident took place in a vehicle, and many other factors impact the overall results of the case. Individuals found guilty of marijuana-related crimes over 30 grams, cultivating marijuana, and other crimes may face up to one year in jail and a fine of up to $5,000. Over 30 grams of marijuana with intent to sell turns the charge into a felony that carries a risk of up to five-years imprisonment and a $15,000 fine. Growing marijuana is also a felony charge in the state.
