Driving under the influence (DUI) is the term used for the crime of operating a vehicle while impaired by an intoxicating agent. Sometimes, laypeople use the terms DUI and drunk driving interchangeably. Alcohol is just one of many substances that can lead to temporary intoxication that is severe enough to make driving unwise. Most DUI suspects are drivers stopped by the police while operating automobiles on public roads. Still, many have been cited while operating golf carts, snowmobiles, motorcycles and other transportation devices. People can be cited for DUI while ambulating across private land.

Despite many years of taxpayer-funded public education campaigns, a large number of people hold dangerous misconceptions about DUIs. This trend has been exacerbated by the fact that these laws vary from state to state. A qualified attorney can help any client navigate jurisdictional issues like these to achieve greater clarity.

Even when taken in normal, prescribed doses, prescription medicines can cause impaired vehicle operation. Using any over-the-counter medicine with the side effect of drowsiness can potentially lead to DUI arrests. In our society, all medication users are expected to take their medications responsibly and adjust their driving patterns as needed. Passing a breathalyzer test does not automatically make a person safe from accusations of impaired driving. Prosecutors often go forward with DUI charges that are solely based on the testimony of officers or other witnesses.

Legal authorities routinely monitor traffic conditions in the course of their duties. Maintaining the public safety requires most police officers to watch drivers closely for signs of impairment. Despite what many people think, there is still no universally acknowledged, tested and effective way to detect intoxication. Field sobriety tests are unscientific, tradition-based exercises that have been demonstrated to produce false positives on a regular basis. It is not at all uncommon for people to face questionable or false DUI charges.

Law enforcement representatives pull over suspected impaired drivers for a variety of reasons. Officers are trained to notice if a driver swerves from lane to lane, speeds or drives slower than traffic. More controversially, some officers are known to engage in profiling practices that may involve stereotyping and discrimination. If a person was falsely accused of driving while impaired, thinking about potential legal consequences could cause severe stress. After all, a DUI conviction can negatively impact many different modern life.

Depending on the severity of the DUI and the amount of damage done, convicted DUI suspects may face jail time, onerous fines and years of probation. In addition, a DUI conviction can dramatically circumscribe one’s personal and professional prospects. A DUI conviction can prevent a person from taking a dream job or traveling to an interesting place overseas.

In some cases, DUI lawyers are able to identify problems or inconsistencies within the prosecutor’s case. In best-case scenarios, lawyers are able to get all charges dismissed. If a DUI citation does make it to the courtroom phase, it is important to have the representation of a seasoned, professional attorney. No matter how enthusiastic, ordinary laypeople can’t realistically expect to understand the ins and outs DUI law. All too often, people take flimsy court evidence at face value without properly holding prosecutors to task.

Trained attorneys can recognize serious deficits in the prosecutor’s methods and evidence. Armed with specialized knowledge, attorneys can present and refute evidence in a manner that can prove persuasive for juries. Attorneys also provide their clients with valuable access to expert witness testimony. By the same token, DUI lawyers are trained to identify any spurious aspects of expert testimony on behalf of the prosecution. In some cases, attorneys have helped people significantly reduce their jail sentences.

In this society, the presumption of innocence is a fundamental part of our civil rights heritage. Arguably, overly aggressive prosecutors undermine defendants’ rights, which are cornerstones of civil society. Lawyers who spend their lives protecting defendants’ rights are true assets to society. Defendants who want to position themselves for success should secure legal representation from well-respected law firms.
